Additional policies are incorporated by reference and form an integral part of these Terms:

  • Privacy Policy (/privacy) - governing data collection and processing

1.1Hierarchy of Legal Terms

These Terms of Sale and Service take precedence over all other legal documents, policies, or terms unless explicitly stated otherwise in a specific written agreement signed by both parties. In case of conflict between different legal documents, these Terms prevail unless mandatory law provides otherwise.

Parents or legal guardians are responsible for ensuring minors under their supervision use the Services responsibly and in accordance with all applicable laws and these Terms.

4Acceptable Use and OSINT Responsibility

You agree to use the Services lawfully and appropriately. Argus Labs provides tools for information gathering and analysis but does not explicitly or implicitly authorize any specific investigation.

4.3OSINT Exclusion Clause

Argus Labs provides Open Source Intelligence (OSINT) tools for legitimate research and cybersecurity purposes. The user acknowledges that the use of these tools to collect, store, or process personal data without the consent of the individuals concerned, or for malicious purposes (doxing, harassment, identity theft), may constitute a criminal offense under applicable laws (including Articles 226-1 et seq. of the French Penal Code). Argus Labs declines all responsibility for any unlawful use of its services.

4.4Compliance with Third-Party Terms

You agree to respect the Terms of Service (ToS) and robot.txt policies of any third-party website or service you investigate using Argus Labs. Argus Labs disclaims any liability for your violation of third-party terms of service, including unauthorized data scraping or automated interactions prohibited by the target platform.

4.5Fair Use Policy

Use of the Services is subject to fair usage limits to ensure performance for all users. We reserve the right to throttle, suspend, or terminate accounts that generate excessive traffic, API requests, or compute usage that significantly exceeds the average usage patterns of other users on the same plan.

5Subscription and payment terms

Pricing is dynamically displayed based on your browser's locale settings or Lemon Squeezy's automatic detection. The actual billing currency and VAT, where applicable, will be clearly indicated at checkout.

Subscriptions are billed via Lemon Squeezy:

  • Monthly or annually, depending on the selected plan
  • Automatic renewal unless cancelled before the billing date

Credits Policy

  • Base consumption per assistant request: 10 credits.
  • Argus Intelligence (orchestrated mode): multiplier x1 → 10 credits.
  • Low-confidence outputs or responses without new entities/links/enrichments: charged at 20% of the applicable cost (rounded to an integer).

VAT is calculated based on your billing address and applicable regulations. Business customers in the EU must provide a valid VAT number if eligible.

If payment fails, Argus Labs reserves the right to suspend or terminate access to the Services.

Argus Labs may modify prices, billing models, or features. Changes affecting existing subscriptions will be communicated in advance.

Argus Labs may offer a referral program to Solo plan users. Details, eligibility, and the most current terms of the referral program are described on the dedicated referral page(s). Rewards or discounts for successful referrals are subject to the rules and conditions outlined there.

Argus Labs reserves the right to modify or discontinue the referral program without notice. Abuse of the program may result in disqualification and account suspension. Rewards are not exchangeable for cash unless explicitly stated.

7Right of withdrawal

For EU/EEA consumers: By subscribing and accessing digital Services immediately, you acknowledge that you waive your legal right of withdrawal under Article L221-28 of the French Consumer Code.

Argus Labs reminds users that subscriptions start immediately upon purchase. No "cooling-off" period applies after accessing paid features.

You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Argus Labs may suspend or terminate accounts:

  • For breach of these Terms

All software, documentation, trademarks, graphics, and other content related to the Argus Labs Suite are the property of Argus Labs or its licensors.

You may not copy, sell, distribute, or create derivative works based on the Services without express written permission, except as expressly permitted by the applicable software licenses for open-source components.

Feedback or suggestions you submit may be freely used by Argus Labs without compensation.

9.2User Content Ownership

You retain all rights and ownership of the data, graphs, and investigations (collectively "User Content") you create using the Services. You grant Argus Labs a worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely as required to provide the Services to you. We do not sell or analyze your User Content for marketing purposes.

10Export control compliance

You acknowledge that the Services may be subject to export control laws and regulations. You agree not to export, re-export, or transfer the Services to countries, persons, or entities prohibited under applicable export control laws.

You represent and warrant that:

  • You are not located in, under the control of, or a national or resident of any country subject to U.S. or EU embargo, UN sanctions, or other applicable trade sanctions
  • You are not on any list of prohibited or restricted parties
  • You will not use the Services for any purposes prohibited by applicable export control laws

Argus Labs reserves the right to refuse service to anyone believed to be in violation of these export control provisions.

11Security and responsible disclosure

Argus Labs encourages responsible disclosure of security vulnerabilities. Researchers are invited to report findings to [email protected] as described in our Security Policy (security.txt).

Argus Labs implements industry-standard security practices but does not guarantee absolute security.

12Privacy and data protection

Argus Labs processes personal data in compliance with applicable laws, including the GDPR and CCPA where applicable.

Please refer to our Privacy Policy (/privacy) for detailed information on data collection, use, rights, and protections.

12.1Data breach notification

In the event of a data breach affecting your personal data, Argus Labs will:

  • Notify affected users without undue delay, typically within 72 hours of becoming aware of the breach
  • Provide information about the nature of the breach, categories of data concerned, likely consequences, and measures taken
  • Communicate through email, account notifications, or other direct means when possible
  • Work diligently to mitigate any potential harm and prevent future breaches

13Disclaimers and limitation of liability

The Services are provided "as is" without warranty of any kind.

Argus Labs disclaims all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Argus Labs is not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or other intangible losses
  • Unauthorized access or use of your data

Argus Labs total liability is limited to the amount you paid for the Services during the three (3) months before the event giving rise to the liability, as further specified in Section 13.3. Argus Labs has no liability toward users of the Community plan.

Certain jurisdictions do not allow limitation of liability; in such cases, minimum liability under applicable law will apply.

13.1Service Provision and Maintenance

  • Nature of Service: Argus Labs is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for continuous uptime and high reliability, you acknowledge that software services may occasionally experience bugs, technical interruptions, or maintenance windows.
  • No Absolute Warranty: Argus Labs makes no warranty that the Services will be entirely error-free or uninterrupted. We do not guarantee the absolute accuracy of external OSINT data retrieved via the platform, as this depends on third-party sources.
  • Data Responsibility: We implement professional-grade security measures (including data encryption at rest). However, you are responsible for maintaining your own backups of critical investigation notes and findings. Argus Labs shall not be liable for any temporary loss of access or data corruption beyond the limits set in Section 13.3.

13.2Artificial Intelligence Disclaimer

The Services may include features powered by Artificial Intelligence (AI) and Large Language Models (LLM). You acknowledge that:

  • Accuracy: AI models can produce inaccurate, incomplete, or misleading information ("hallucinations"). You should always verify AI-generated insights against primary sources.
  • Decision Making: You should not rely solely on AI output for critical decisions (legal, financial, or safety-related).
  • Liability: Argus Labs disclaims any liability for errors, omissions, or offensive content generated by AI models.

13.3Limitation of Liability and Warranty

The software is provided "as is". While we strive for maximum uptime and security, the user acknowledges that no software is entirely error-free. We do not guarantee the accuracy or timeliness of third-party OSINT data.

In no event shall the developer's total liability exceed the total amount paid by the user during the three (3) months preceding the event giving rise to the claim.

13.4Dependencies on Third-Party Services

The Services may interact with or depend on third-party platforms, APIs, or data sources (e.g., social networks, public databases). You acknowledge that Argus Labs has no control over these third parties. If a third party modifies, restricts, or discontinues access to their data or API, Argus Labs may cease to provide the affected features without entitling the User to any refund or compensation. Such interruptions shall not be considered a breach of these Terms.

13.5Beta Services

Argus Labs is currently provided as a Beta service. During this phase, you acknowledge and accept that:

  • Features may be incomplete, subject to change, or removed without prior notice.
  • The platform may experience interruptions, bugs, or unexpected behavior inherent to early-stage software.
  • User data (including investigations, graphs, and uploaded files) may be subject to resets or migrations; advance notice will be provided where reasonably possible.
  • Service Level Agreements (SLAs) and uptime guarantees do not apply during the Beta phase.
  • Argus Labs disclaims any liability for losses arising from Beta instability, including data loss, service interruptions, or feature changes.

Participation in the Beta phase is voluntary. By continuing to use the Services, you acknowledge the Beta nature of the platform and accept the associated risks.

14Changes to services

Argus Labs may modify, suspend, or discontinue any part of the Services at any time.

When feasible, users will be informed in advance, especially for significant changes affecting paid subscriptions.

If Argus Labs discontinues a Service entirely, users with active subscriptions may be eligible for a pro-rated refund at Argus Labs discretion.

15Governing law and jurisdiction

These Terms are governed by the laws of France.

Any disputes arising from these Terms or the Services will be submitted to the exclusive jurisdiction of the courts of Paris, France.

15.1Alternative dispute resolution

Prior to initiating formal legal proceedings, the parties agree to attempt in good faith to resolve any dispute through negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may propose mediation through a mutually acceptable mediator.

This alternative dispute resolution provision does not prevent either party from seeking injunctive or other urgent legal relief when necessary to protect its rights.

If mandatory local consumer protection laws apply, they are not affected by this clause.
